Terms of Sale
These terms of sale are concluded, on the one hand, by SNC DEFOUR, whose activity is legally declared under the name SNC DEFOUR, hereinafter referred to as “the seller”, and on the other hand, by any natural or legal person wishing to make a purchase via this site, hereinafter referred to as “the buyer”.
The site is the property of SNC DEFOUR and its manager Marc DEFOUR in its entirety, as well as all related rights. Any reproduction, in whole or in part, is systematically subject to the owners’ authorization. However, hypertext links to the site are authorized without specific requests.
Acceptance of conditions
The customer acknowledges having read, at the time of placing the order, the specific terms of sale stated on this screen and expressly declares to accept them without reservation.
These general terms of sale govern the contractual relations between SNC DEFOUR and its customer, both parties accepting them without reservation.
These general terms of sale shall prevail over all other conditions appearing in any other document, unless prior, express, and written derogation.
The seller reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in force on the date of the buyer’s order.
Products
The items presented on this site are valid only within the limits of available stock and in the countries served by the service provider La Poste.
In the context of sales, product offers are valid as long as they are visible on the site, within the limits of available stock. In the event of an exceptional stock management malfunction and in the event of product unavailability after the buyer’s order is placed, the seller will notify the customer by email of the delivery of a partial order or the cancellation of their order. Should the buyer’s bank account have been debited, the seller will initiate an immediate refund procedure. The customer’s account will be credited again.
The delay will depend on the type of bank card held: 3 to 8 days for an immediate debit and end of month for a deferred debit.
Order
Automatic recording systems are considered as proof of the nature, content, and date of the order.
SNC DEFOUR confirms the acceptance of its order to the customer at the email address provided by the latter. The sale will only be concluded upon order confirmation.
The seller reserves the right to cancel a customer’s order, particularly if there is a dispute regarding the payment of a previous order. The information provided by the buyer when placing the order is binding on them. In case of an error in the recipient’s contact details, the seller cannot be held responsible for any inability to deliver the product.
Right of withdrawal
4.1 Right of Withdrawal
In accordance with current legal provisions, the Customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to provide reasons or pay a penalty, for the purpose of a credit note valid on the online store or in a physical store, provided that the Products are returned in their original packaging and in new condition with the purchase tag, unworn, unwashed, no later than fourteen (14) days following the notification to the Seller of the Customer’s decision to withdraw. Returns must be made in their original and complete condition (packaging, accessories, instructions…). Products that do not meet these conditions, or that are damaged or incomplete, will not be accepted for return. The right of withdrawal must be exercised by mail or email to the Seller at the address mentioned herein.
In the event of exercising the right of withdrawal within the aforementioned period, only the price of the purchased Product(s) will be refunded in the form of a credit note; return shipping costs are borne by the customer for any delivery made in France.
For returns from abroad (outside France), return shipping costs are borne by the customer, in which case, no processing fees will be deducted from the credit note for the returned and compliant item(s).
Proof of the effective exercise of the right of withdrawal rests with the Buyer.
The Seller reserves the right to defer the credit note until the Product is recovered or proof of shipment of this Product by the Buyer is received, the date taken into account being the earlier of these events.
4.2 Limits to the Right of Withdrawal
In no case shall the Buyer’s exercise of the right of withdrawal be abusive. In any event, any Order returned incomplete, including explanatory notices, damaged, used, washed, deteriorated, soiled, or even partially consumed, will not be refunded. The Buyer’s liability may be engaged in case of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the Products’ content. To establish the nature, characteristics, and proper functioning of the Products, the Buyer may only handle and inspect them in a manner that would also be permitted in a store. For example, they may only try on an item of clothing and not wear it. Therefore, the Buyer should handle and inspect the clothing with all necessary precaution.
Delivery
After order confirmation, the seller undertakes to deliver to its carrier all items ordered by the buyer within a maximum period of 18 working days.
Furthermore, for deliveries outside metropolitan France, the customer undertakes to pay all taxes due on the import of products, customs duties, value-added tax, and all other taxes due under the laws of the country of receipt of the order. The seller is de facto released from all legal responsibilities if the payment of taxes is not made by the customer.
Delivery will be made by Chronopost or Colissimo.
Deliveries to EEC countries are made by La Poste via Colissimo tracked Europe or Chronopost.
For deliveries outside the EEC, deliveries are made by international postal services. Goods always travel at the recipient’s risk. Always check your package upon arrival. You have 48 hours to make any reservations with the carrier in case of damage.
Price
The price is expressed in euros.
The price indicated on the product sheets includes transport for orders delivered in France. For deliveries to other countries, shipping costs are added during the final step of the purchase.
The price indicated in the order confirmation is the final price, expressed all taxes included for France and EEC countries. This price includes the price of the products, handling fees, packaging, transport costs, and commissioning fees.
The seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. Shipping costs are borne by the buyer; they include the shipping price (current La Poste rates), packaging, and logistics fees.
For the rest of the world, various customs fees and taxes may be added to the price initially indicated on the site. These remain the sole responsibility of the buyer.
Disputes
This contract is subject to French law. SNC DEFOUR cannot be held responsible for damages of any kind, whether material, immaterial, or bodily, that may result from a malfunction or improper use of the marketed products.
The liability of SNC DEFOUR will in any event be limited to the amount of the order and cannot be questioned for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, notably with the help of a professional association in the sector, a consumer association, or any other advisor of their choice. It is recalled that seeking an amicable solution does not interrupt the “short period” of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that, as a general rule and subject to the appreciation of the Courts, compliance with the provisions of this contract relating to the contractual guarantee implies that the buyer honors their financial commitments towards the seller.
Complaints or disputes will always be received with attentive goodwill, good faith always being presumed on the part of anyone who takes the trouble to explain their situation. In case of a dispute, the customer will primarily contact the company to obtain an amicable solution.
Failing this, the Commercial Court of Paris shall have sole jurisdiction, regardless of the place of delivery and the accepted method of payment.
Legal Information
The provision of personal information collected for the purpose of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide information results in the non-validation of the order.
In accordance with the “Data Protection Act”, the processing of personal data relating to customers has been declared to the National Commission for Information Technology and Liberties (CNIL). Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by SNC DEFOUR.
The price of the products is payable in full on the day of the effective order.
Payments will be made via the secure Stripe platform.
Intellectual property and counterfeiting.
SNC DEFOUR is the owner of intellectual property rights and holds the rights of use over all elements accessible on the website, including texts, images, graphics, logos, videos, architecture, icons, and sounds.
Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited, unless prior written authorization from SNC DEFOUR
Any unauthorized use of the site or any of its elements will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.
